Under Section 1033 of the National Defense Authorization Act for Fiscal Year 1997 (10 U.S.C. § 2576a), the Secretary of Defense may transfer Department of Defense (DoD) personal property—including weapons—to federal and state law enforcement agencies for use in law enforcement activities.
Because the direct issue of small arms from Anniston, AL, ceased in 2012, the only way to obtain small arms through this program is via a direct transfer from an agency that no longer requires its LESO-issued weapons. Allocation limits are capped at a strict 1:1 weapon-to-officer ratio (100% allocation) for all weapon types.

MANDATORY SECURITY REQUIREMENT: Participating agencies must secure all weapons not actively in use under a minimum of two (2) levels of physical security. Ensure your agency can fully meet and maintain this storage standard before submitting a request.
How to Request a Weapon Transfer

- Submit for Review: Email your signed, completed request form to txlesoprogram@dps.texas.gov.
- Agency Matching: Once your paperwork is approved, the Texas LESO office will match your agency with authorized LEA turning in their weapons and issue detailed transfer instructions.
